Shipping and Delivery

At this time, Nomadic Archer ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. Additionally, Nomadic Archer ships merchandise to Canada and Mexico, but not to other international locations. The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.

International

Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

1. Agreement Acknowledgment

This End User License Agreement ("EULA") is a legal agreement between you ("End-User" or "you") and Nomadic Archer, LLC ("Developer," "we," "us," or "our") for the Nomadic Archer mobile application ("Licensed Application" or "App").

Platform-Specific Acknowledgments:

  • For iOS Users: You acknowledge that this EULA is concluded between you and Nomadic Archer, LLC only, and not with Apple Inc. ("Apple"). Nomadic Archer, LLC, not Apple, is solely responsible for the Licensed Application and its content.
  • For Android Users: You acknowledge that this EULA is concluded between you and Nomadic Archer, LLC only, and not with Google LLC ("Google"). Nomadic Archer, LLC, not Google, is solely responsible for the Licensed Application and its content.

By downloading, installing, or using the Licensed Application, you agree to be bound by the terms of this EULA.

2. Application Description and Purpose

The Nomadic Archer mobile application is designed to help archers track their practice sessions, log their shots, and improve their archery skills through data analysis and practice management tools.

3. Scope of License

3.1 License Grant

Nomadic Archer, LLC grants you a limited, non-transferable, non-exclusive, revocable license to use the Licensed Application for personal, non-commercial purposes, subject to the terms of this EULA.

3.2 Platform-Specific Usage

  • iOS: The license is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The Licensed Application may be accessed and used by other accounts associated with your purchase via Family Sharing or volume purchasing.
  • Android: The license is limited to use on Android devices that you own or control, as permitted by the Google Play Terms of Service.

3.3 Restrictions

You may not:

  • Copy, modify, or distribute the Licensed Application
  • Reverse engineer, decompile, or disassemble the Licensed Application
  • Use the Licensed Application for commercial purposes without prior written consent
  • Remove or alter any proprietary notices or labels

4. User Eligibility and Account Requirements

  • The App is intended for individuals who are at least 13 years old
  • You must create an account using a valid email address
  • You agree to receive newsletters and blog updates from Nomadic Archer
  • You are responsible for maintaining account security and all associated activities

5. Subscription Terms and Payments

5.1 Subscription Model

  • 7-day free trial for new users
  • Automatic renewal unless cancelled before renewal date

5.2 Payment Processing

  • Providing maintenance and support services
  • Addressing technical issues and bug fixes
  • Customer service and user support

7.2 Platform Store Limitations

  • iOS: Apple has no obligation to provide maintenance or support services
  • Android: Google has no obligation to provide maintenance or support services

8. Warranties and Disclaimers

8.1 Developer Warranties

Nomadic Archer, LLC is solely responsible for any product warranties, express or implied by law, to the extent not effectively disclaimed.

8.2 Platform-Specific Warranty Terms

  • iOS: If the Licensed Application fails to conform to any applicable warranty, you may notify Apple for a refund. Apple has no other warranty obligations regarding the Licensed Application.
  • Android: Google provides no warranties regarding the Licensed Application beyond what is required by applicable law.

8.3 General Disclaimers

  • The App is provided "as is" without warranties of availability, reliability, or accuracy
  • We disclaim all warranties not expressly stated herein
  • INJURY DISCLAIMER: Nomadic Archer, LLC is not liable for injuries arising from archery practice while using the App

9. Limitation of Liability

To the fullest extent permitted by law, Nomadic Archer, LLC shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Data loss or technical malfunctions

  • User-generated content remains your property, but you grant us a license to use it for app functionality and improvement

11. Third-Party Terms and Services

11.1 Compliance Requirement

Google and its affiliates are third-party beneficiaries of this EULA to the extent provided in the Google Play Terms of Service.

14. Termination

14.1 Termination by Developer

We may suspend or terminate your access for:

  • Violation of this EULA
  • Unlawful or harmful activities
  • At our sole discretion with reasonable notice

14.2 Termination by User

  • You may terminate your account anytime through account settings
  • Termination does not entitle you to refunds for unused subscription periods
  • Your obligations under this EULA survive termination

15. Dispute Resolution

15.1 Arbitration
